Divorce

My divorce practice runs the gamut from simple to highly complex matters related to contested visitation or custody, asset distribution, retirement plans, and DNA and paternity testing. While divorce can be an emotional issue, I educate my clients so that they can make informed legal decisions.

Child Custody / Visitation

At the Law Office of Douglas A. Oberdorfer, P.A., I attempt to correct the perception that the father cannot get custody of the child. In any marriage dissolution, a judge or mediator will decide custody and visitation matters by focusing on the best interests of the children.

Child Support

I believe that each parent has a duty to support his or her child. Generally, there are guidelines that set forth the amount of child support you may be required to pay based on you and your spouse's salary and deductions. The guidelines are not absolute, and there are exceptions involving the amount of visitation time a parent receives.

Alimony / Spousal Support

Alimony and spousal support fall into three categories: permanent, lump sum, and rehabilitative. I have aggressively represented both husbands and wives in obtaining spousal support following a divorce.

Division of Marital Assets & Debt

Florida is an equitable distribution state, which means that all marital assets and debts will be divided in a way that provides for a fair, but not necessarily equal, allocation of property. As your attorney, I will review all marital assets and any debts to ensure that there is an equitable distribution of assets between you and your spouse.

Probate

Probate provides for the orderly transfer of assets. As a probate lawyer, I assist the surviving family and friends in distributing the estate. If there is no will, I will follow the probate administration rules of the Florida Code. When dealing with probate matters, legal and emotional issues tend to combine, and I am here to help you with both.

Estate Planning

I tell my clients that they do not have to be rich and famous to need an estate plan. Creating an estate plan is a proactive step that gives you peace of mind that your loves ones will be taken care of following your death. You can also set forth your wishes related to health care surrogates and directives in a written document.

Wills & Trusts

Wills and trusts can be used to distribute your estate to family members, favorite charities, the college you attended, or anyone else you choose. I handle all issues involving wills and trusts from the initial drafting stage to any litigation involving the will or trust.

Criminal Law

My experience in private practice is enhanced by my previous experience as a prosecutor. I have handled cases in juvenile court, as well as felony cases that carry the potential of life in prison. I have also handled criminal cases involving allegations of white collar crime, DWI, drug possession, assault, and domestic violence.
